On March 15, a two-judge panel of the court dismissed the PIL, finding that nothing could tarnish the reputations of great personalities Alluri Seetha Ramaraju and Komaram Bheem.

Public Interest Litigation (PIL) filed

A PIL (public interest litigation) can be filed by any member of the public – be they an ordinary man, NGO, or social activist – for a redress of injury caused by violations of legal rights. It serves as a mechanism that ensures public involvement in the judicial review of administrative actions.

The Supreme Court has established guidelines to manage and dispose of PILs. It is essential for the court to guarantee petitioners are acting with good intentions, not seeking redress of personal interests or private gain.

Additionally, PILs help safeguard the courts from being used by political pressure groups to stall legitimate administrative action or further their political objectives. Abuse of PILs is unfortunately all too common and has often resulted in delays or even quashing genuine cases.

In 2010, the Supreme Court imposed strict guidelines on courts when entertaining Personal Interest Liens (PILs). It has long been believed that people file frivolous petitions in an effort to gain publicity, placing an immense burden on our judicial system.

Public interest litigations can be brought before any High Court or Supreme Court by individuals, groups or institutions for the redress of grievances and violations of rights. Such matters include non-payment of wages, bonded labour matters, women’s rights, environmental pollution and more.

Indian courts are currently hearing several Public Interest Litigations (PILs) to safeguard and enforce various rights and interests. These range from child abuse redressal to women’s rights protection, cultural heritage preservation, ecological balance maintenance and more.

Recently, the Supreme Court has been hearing a number of Public Interest Litigations (PILs). One such case was filed by a student from West Godavari district who challenged the film ‘RRR’ due to its distortion of freedom fighters Alluri Seetharama Raju and Komaram Bheem’s histories as British police officers. To prevent its release, they have asked the court to deny censor certificate issued by Censor Board and hold off on screening the movie until further notice.

A woman from the West Godavari district of Andhra Pradesh has filed a Public Interest Litigation (PIL) against SS Rajamouli’s upcoming film RRR, alleging it distorts the history of Legendary Freedom Fighters Alluri Sitarama Raju and Komaram Bheem with the intent to hurt their feelings. She demands that both censor certificates be refused and a stay be placed on its release.

Alluri Sowmya from Undrajavaram in West Godavari filed a Public Interest Liability (PIL) against the movie Sitarama Raju: she claimed it depicted him as a police officer which went against their lifestyle and hurt thousands of their followers’ feelings. On Tuesday, a two-judge bench consisting of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavali dismissed the PIL. They held that nothing could harm the reputations of great personalities like Alluri Sitarama Raju or Konar Ramaraju; “Poison may kill Socrates but not his ideas or literature,” they declared.

Furthermore, the judges urged the makers to take appropriate steps in order to avoid any controversy during its release. They further requested that the censor board ensure no copyright infringement takes place.

Recall, the film was initially scheduled to hit screens on January 7 but had to be postponed due to increased Covid-19 cases. According to the director, if these numbers continued rising, then the release of the movie would not be possible.

Meanwhile, the ‘RRR’ movie started trending on social media with many calling for a boycott in Karnataka due to the Kannada version being given less priority compared to Tamil, Telugu and Hindi versions.

The film received critical acclaim for its direction, cinematography, action sequences, script, music and performances. It earned international accolades and became one of the top ten-grossing films in India.

On February 17, 2021, Lyca Productions acquired Tamil Nadu theatrical rights for RRR and Pen Studios took over North Indian rights. The film is set for release on July 30, 2020.

Hearing venue

Before the film was released, SS Rajamouli’s magnum opus ‘RRR’ featuring Jr NTR and Ram Charan was challenged in court over its story based on freedom fighters Alluri Sita Ramaraju and Komaram Bheem which were alleged to be twisted. Alluri Soumya from West Godavari district filed the petition requesting that the film be postponed and not given a censor certificate.

Alluri Soumya holds that this litigation is of public interest and the court should prevent the release of ‘RRR’ since it destroys the history of Alluri Sita Ramaraju and Kambaram Bheem. She stated that the story behind Alluri Sita Ramaraju had been embellished, making it untrue; additionally, the history behind Komaram Bheem had also been falsified in the film; therefore, she believes the movie should not be released.

Produced by DVV Danayya and directed by SS Rajamouli, the film stars NTR and Ram Charan as the lead roles, with Ajay Devgn and Alia Bhatt playing supporting roles. Samuthirakani, Shriya Saran, Ray Stevenson, and Alison Doody also star in various other roles.

There have been several controversies surrounding the movie ‘RRR’, one of them being its promo featuring a character wearing a skull cap. Siddipet State President and Karimnagar MP Bandi Sanjay took issue with this scene and urged producers to remove it from the film.

However, the court has rejected her appeal and ordered that ‘RRR’ be released. As a result, there will be a CJ tribunal hearing held shortly; it will be interesting to observe how this issue is handled.

According to reports, the film will resume shooting on October 22 in Mahabaleshwar. According to the latest update on the shoot, 1000 fighters have been recruited for ‘RRR’s’ action sequence.

The new schedule of ‘RRR’ has begun and it is already winning over viewers’ hearts. Reports indicate that the film will now be shot in two locations – Mahabaleshwar and Gujarat.

Decision

She claimed that the depiction of the life history of two freedom fighters in RRR is contrary to their lifestyle and misrepresents reality. In her plea, she requested the court to issue a censor certificate and prevent producers from releasing the film.

The petitioner had also expressed dissatisfaction with the portrayal of Martyr Alluri Seetharamaraju as a police officer, which she felt is at odds with his lifestyle. Additionally, she felt that the film is damaging Alluri Sita Ramaraju’s image and legacy by portraying her as an ordinary police officer.

SS Rajamouli’s directorial, directed by him, is set for release this year and stars Jr NTR, Ram Charan and Alia Bhatt in the lead roles. However, it has faced numerous controversies and was postponed indefinitely due to an increase in cases of the Omicron COVID-19 pandemic.

Recently, Telangana BJP chief Bandi Sanjay Kumar delivered another blow to the movie by ordering them not to include any visuals featuring Jr NTR wearing a Muslim skull cap in its trailer.

The BJP believes this will cause a deep political rift amongst tribal communities and people across Andhra Pradesh, Telangana and Maharashtra. Furthermore, the Telangana BJP has threatened to burn down every theatre showing the movie if its character is depicted as Muslim.

The Telangana High Court has now directed the filmmakers to re-release the movie if it does not harm Alluri Sita Ramaraju and Komaram Bheem’s image. But they are yet to respond to the court’s order – it will be interesting to see their response.
